ATR Performance Refund & Return Policy
Effective Date: [DATE]
At ATR Performance, we want you to receive the correct automotive part in good condition. This Refund & Return Policy applies to purchases made through the ATR Performance website and is intended to comply with applicable Texas and federal law.
1. Returns for Unwanted or Incorrectly Ordered Parts
ATR Performance accepts returns of eligible parts within 30 days of delivery, provided that:
-
The part has not been installed, used, modified, disassembled, damaged, or altered.
-
The part is in resalable condition.
-
All original packaging, labels, manuals, hardware, and accessories are included where applicable.
-
The customer provides proof of purchase or the original order number.
-
The item is not a special-order, custom, programmed, modified, or otherwise non-returnable product that was identified as such before purchase.
For eligible returns that are not the result of an error by ATR Performance, the customer is responsible for return shipping costs.
ATR Performance may charge a restocking fee of up to 20% for eligible returns that are not caused by an error on our part, provided the fee was disclosed before or at the time of purchase.
2. Incorrect, Damaged, or Defective Parts
If ATR Performance ships the wrong part, a part arrives damaged, or a part is defective, please contact us as soon as reasonably possible.
ATR Performance may request photographs, the vehicle identification number (VIN), diagnostic information, installation information, or other information reasonably necessary to investigate the issue.
If the part is determined to be defective or ATR Performance shipped the wrong part, we may, as appropriate:
-
Provide a replacement;
-
Provide a repair or other applicable remedy; or
-
Issue a refund.
When the issue is caused by an ATR Performance shipping error or a covered defect, ATR Performance will provide appropriate return instructions and will cover applicable return shipping costs.
Nothing in this policy limits any warranty, remedy, or other right that cannot lawfully be excluded or limited under applicable law.
3. Installed Parts
Automotive parts that have been installed are generally not eligible for return due solely to a change of mind, incorrect ordering, or dissatisfaction with fitment.
This restriction does not apply to a valid claim involving a defective part, a part incorrectly supplied by ATR Performance, or another remedy required by applicable law or an applicable warranty.
Customers are responsible for verifying vehicle compatibility before installation. Customers should provide complete and accurate vehicle information, including year, make, model, engine, VIN, and any other information requested by ATR Performance when requesting fitment assistance.
4. Electrical and Electronic Parts
Electrical and electronic components may be subject to additional return restrictions because installation or attempted installation may affect the condition of the product.
Electrical or electronic parts may be non-returnable after installation unless the product is defective, ATR Performance supplied the wrong product, or another return or warranty right applies under applicable law.
5. Special-Order and Custom Parts
Special-order, custom, modified, programmed, coded, or otherwise non-standard parts may be non-returnable when this restriction was clearly disclosed before purchase.
This restriction does not eliminate any rights or remedies available to the customer under applicable law or an applicable warranty.
6. Core Charges
Where a product includes a refundable core charge, the core must meet the return requirements stated on the applicable product listing or order documentation.
Core returns must generally be complete and substantially equivalent to the core described in the applicable listing. A core that is missing major components, severely damaged, or otherwise outside the stated requirements may not qualify for a full core refund.
Any applicable core refund will be processed after the returned core has been received and inspected.
7. Return Authorization
Customers should contact ATR Performance before sending a return.
ATR Performance may issue a Return Merchandise Authorization (RMA) number and provide return instructions.
Customers should not send a return to an ATR Performance warehouse or business address unless ATR Performance has provided the applicable return instructions.
8. Refunds
After an eligible return is received and inspected, ATR Performance will notify the customer whether the return has been approved.
Approved refunds will generally be issued to the original payment method.
Refunds will normally be processed within 7 business days after approval. The time required for the refund to appear in the customer's account may depend on the customer's bank, credit-card issuer, payment processor, or other financial institution.
Unless otherwise required by law or stated in this policy, original shipping charges are non-refundable for returns made solely because the customer changed their mind, ordered the wrong part, or no longer wants the part.
9. No Automatic Three-Day Return Right
Texas law does not generally provide consumers with an automatic three-day right to cancel ordinary purchases simply because they changed their mind.
ATR Performance's voluntary return policy therefore governs ordinary returns, subject to any rights and remedies that cannot legally be waived.
10. Warranties
Certain products may be covered by a manufacturer's warranty or a separate written warranty provided by ATR Performance. Where a written warranty applies, its terms will govern the scope and duration of that warranty.
Nothing in this Refund & Return Policy is intended to disclaim or improperly limit any warranty or remedy that cannot legally be disclaimed or limited.
11. Product Descriptions and Fitment
ATR Performance makes reasonable efforts to ensure that product descriptions, photographs, specifications, and fitment information are accurate.
Vehicle configurations may vary based on model year, production date, engine, trim level, drivetrain, VIN, factory options, and previous modifications.
Customers are responsible for verifying compatibility before ordering and, where appropriate, should have a qualified automotive technician confirm fitment and installation requirements.
Nothing in this section limits any rights arising from an inaccurate product description, express warranty, applicable implied warranty, or other rights provided by law.
12. Fitment Assistance
If a customer provides ATR Performance with a VIN or other vehicle information for fitment assistance, the customer is responsible for ensuring that the information provided is complete and accurate.
If ATR Performance confirms that a particular part is suitable based on the information supplied by the customer, that communication may be considered when determining whether the part conforms to the transaction.
13. Misuse, Improper Installation, and Modified Vehicles
ATR Performance is not responsible for damage caused by improper installation, misuse, neglect, racing or competition use, modification, abuse, incorrect installation procedures, or failure to follow applicable manufacturer instructions, except to the extent otherwise required by applicable law or an applicable warranty.
Customers are responsible for ensuring that parts are installed correctly and, where appropriate, by a qualified professional.
14. Refund Policy and Consumer Rights
ATR Performance will not intentionally misrepresent the condition, compatibility, warranty, availability, or characteristics of goods sold through its website.
Nothing in this policy is intended to waive or restrict any consumer right or remedy that cannot legally be waived under applicable Texas or federal law.
15. Policy Changes
ATR Performance may update this Refund & Return Policy from time to time.
The version of the policy applicable to an order will generally be the version in effect when the purchase was made, except where applicable law requires otherwise.
